In the Repsol (CJEU, April 20, 2023, C-25/21, Repsol Comercial de Productos Petrolíferos SA) and Paccar (CJEU, November 10, 2022, C-163/21, PACCAR / DAF Trucks / AD and others) rulings, the Court of Justice seems to have adopted a logic of lightening the burden of proof for claimants in the application of the Damages Directive. This raises questions about the difficulty of producing evidence, but also about the judge’s power to assess the probative value of evidence.
