On 30 June 2026, the Patent and Market Court of Appeal (part of Svea Court of Appeal) overturned a ruling by the Patent and Market Court. The decision annulled referred to Swedish Competition Authority’s finding that the faucet distributor Tapewell had engaged in unlawful resale price maintenance with the two online resellers, Home Online and Hemgallerian.
The Court of Appeal found the evidence too weak to prove that Tapwell and the resellers had agreed to a binding pricing policy. Much of the evidence was considered indirect, including how closely the resellers' prices tracked the alleged policy. The court held that the market price pattern was not decisive on its own. As a result, the SEK 16.9 million fine was set aside in full.
RBB acted as economic experts during the proceedings. This included economic reasoning regarding the Authority's empirical pricing analysis, and on what conclusions such an analysis can and cannot support.
