The Brussels School of Competition is pleased to invite you on a Morning Briefing on New study on the passing-on of overcharges, Friday 16 December from 8.30 to 10.00 in Brussels.In October 2016, the European Commission published a new study on the passing on of overcharges. This study is intended to provide judges, and other practitioners who are not economic experts, with practical guidance on obtaining and assessing economic evidence in relation to pass-on in the context of competition law infringements.The Study precedes the forthcoming Guidelines on assessing passing-on of overcharges and the implementation of Directive 2014/104/EU ("Cartel Damages Directive") across the EU. It sets out a framework for evaluating the plausibility of claims, for quantifying the effects of pass-on, and, accordingly, for assessing the total extent of the harm suffered by a claimant.The new study also contains a practical checklist of issues which may arise, organised around a set of key questions, which is designed to help courts understand and evaluate the economic evidence adduced.Benoît Durand, Partner of RBB Economis and Filip Kubik, Policy Analyst from European Commision will be speaking at the event.
