On 9 September 2014 the European Commission cleared at phase I the acquisition of Channel 5 Broadcasting by Viacom. Both Viacom and Channel 5 are active in the UK in the licensing or acquisition of broadcasting rights to audio-visual content, the wholesale supply of television channels, the retail supply of audio-visual content and TV advertising. The Commission’s investigation focused on TV advertising. RBB worked with Shearman & Sterling, counsel to Viacom, to demonstrate the limited overlap and absence of closeness of competition.
