“3 to 2” merger granted unconditional clearance by the Swiss Competition Commission

On 18 August 2008 the Swiss Competition Commission unconditionally cleared the acquisition by Heineken Switzerland of rival brewer Eichhof. The transaction, which reduced the number of national brewers from 3 to 2, was subject to an in-depth (Phase II) investigation. Concerns of collective dominance were ultimately dismissed because there was evidence of intense competition pre-merger and because the extent of transparency and other characteristics of the market were not conducive to coordinated behaviour.RBB Economics assisted the merging parties during the in-depth investigation alongside lawyers von der Crone Rechtsanwälte.
