In addition to working on numerous EC cases involving analysis of German national markets, the economists at RBB have acquired extensive experience of domestic cases considered by the Bundeskartellamt. Our experience in such cases spans a wide range of industries including branded consumer goods, metals, packaging, airlines, construction materials, computer software, telecommunications, automotive products, and the petrochemicals sector. In addition, one of RBB’s economists has previously undertaken a secondment to the Bundeskartellamt.

  • Cement cartel: RBB advised one of the major cement producers in Germany in the context of an appeal against the fine levied on the industry by the Bundeskartellamt for alleged cartel infringements. Our expert economic report contained an in-depth analysis of the market and a quantification of the impact of the firms’ behaviour on prices and competition.
  • Shell/DEA: Two of our experts formed the core team in providing extensive economic advice to Shell in connection with its takeover of DEA before the European Commission as well as before the Bundeskartellamt. Our work ranged form advising on the notification over empirical analyses to numerous meetings and presentations at the Merger Task Force and the Bundeskartellamt.
  • CVC/Lenzing: RBB economists advised CVC and Lenzing on the proposed merger of Lenzing’s and Accordis’s man-made fibres business used in both textile and other production processes. This merger was subject to a Phase II investigation.
  • Lufthansa: RBB economists advised Lufthansa during the European Commission’s investigation of its joint venture with SAS under Article 81. In particular, they advised on the appropriateness of ceding airport landing and take-off slots as a condition for allowing the joint venture to proceed.
  • Economic advice on a merger in the field of luxury branded goods before the Bundeskartellamt. One of the main issues was the definition of the relevant product market.
  • Provision of confidential expert economic advice to a third party with an interest in the proposed Mannesmann/Vodafone merger.
  • Preparation of a confidential expert report for a large multinational company in connection with the notification of a joint venture for submission to the Bundeskartellamt.
