The UK Competition Appeal Tribunal has upheld an appeal by UniChem Limited against the Office of Fair Trading’s decision to clear the acquisition of pharmaceutical wholesaler East Anglian Pharmaceuticals by Phoenix Healthcare Distribution without a referral to the Competition Commission. The CAT took the view that the OFT’s decision was insufficiently supported by the evidence, and referred the case back to the OFT for re-consideration. An RBB team led by Simon Baker assisted UniChem and its legal advisers Allen and Overy throughout the OFT’s investigation and the subsequent appeal..
