CMA approves Iron Mountain's acquisition of Recall with commitments

On 16 June 2016, the UK Competition and Markets Authority (“CMA”) approved the acquisition of Recall by Iron Mountain, subject to commitments.  The Parties overlapped in the supply of records management services (“RMS”) and off-site data protection services (“OSDP”) in the UK.  After a detailed Phase 2 investigation, the CMA concluded that the parties would remain effectively constrained by a number of alternative suppliers in most of the UK and commitments were required to address competition concerns in certain areas of Scotland.  RBB worked alongside Weil Gotshal & Manges, legal advisers to Iron Mountain.
